High Court Judge Gino Persaud on Friday ruled that President Irfaan Ali violated Guyana’s Constitution by suspending the then Chairman of the Police Service Commission (PSC), including Retired Assistant Police Commissioner Paul Slowe because there was no mechanism to give him a fair hearing.
DISPOSITION
It is hereby ordered and declared that judgment be and is hereby granted in favour of Paul Slowe as prayed for in para 1 of the FDA in
the following terms:
That the suspensions of the Chairman and members of the Police Service Commission (“the Commission”), namely Chairman Mr. Paul
Edmond Slowe, CCH, DSM, JP and Commissioners Mr. Michael Somersall, CCH, DSM, JP, Mrs. Claire Alexis Jarvis, Mrs. Vesta Adams
and Mr. Clinton Andrew Conway, from performing the functions of their respective offices in the Commission, which His Excellency, the President of the Co-operative Republic of Guyana did order by letter on June 16, 2021, were contrary to, in violation of, and ultra vires the Constitution of the Co-operative Republic of Guyana (“the Constitution”) and in particular Articles 225 (6) and 210 (3), and therefore of no force and effect.
